Upon submitting the “Wine Appreciation Class” form on the Philomathean.org website and electronically signing my name as indicated on that form, I agree to be bound to the following terms and conditions:
(a) I agree that my acceptance in the class is predicated on my
(i) being a full-time Penn undergraduate, graduate, or professional student, or another Penn affiliate approved to participate in the Class by the University and the Philomathean Society Wine Appreciation Class Committee (hereafter “the Committee”),
(ii) being twenty-one years of age on March 23th, 2011, and
(iii) remission of full payment of class tuition to the Philomathean Society.
Should I fail to meet any of these conditions I shall be removed me from the class and reimbursed only at the discretion of the Committee. Should my alternate fail to meet conditions (i) and (ii) and nonetheless attempt to participate in the class on my behalf, both the alternate and I shall be removed from the class and my tuition will not be reimbursed.
(b) I agree to attend all classes unless a severe conflict arises, and if I cannot attend class to make arrangements for my alternate to attend class with notice to the Committee. If my alternate is unable to attend the class, I may, with the consent of the Committee, designate an emergency alternate who shall be bound by all the provisions of these terms and conditions in the same manner as my alternate and myself. Should no person be able to take my place, I acknowledge that I may not be granted a refund for the class I missed.
(c) I agree that I may be removed from the Class at any time at the discretion of the Committee or a representative of the Vice Provost of University Life if my behavior during, or immediately before and after the class is disruptive to the education or safety of those around me. I further acknowledge that egregious violations of University behavior or other policies will be referred to the Office of Student Conduct or other authorities as appropriate.
(d) I agree that I will not be refunded my tuition fee unless I do not secure a place in the class. All other refunds shall be granted solely at the discretion of the Committee.
(e) I agree to RELEASE, HOLD HARMLESS, DEFEND AND INDEMNIFY the Wine School of Philadelphia, the Trustees of the University of Pennsylvania, and Philomathean Society of the University of Pennsylvania, and their employees and officers, from and against any damage, liability, loss or claim which in any way may arise from or relate to the Wine Appreciation Class from the Philomathean Society.
I further agree to reimburse the Wine School of Philadelphia, the Trustees of the University of Pennsylvania and/or the Philomathean Society of the University of Pennsylvania with respect to any claim, loss, demand, cause of action, cost or liability (including reasonable attorneys fees and expenses) which may be asserted against or incurred by the Trustees of the University of Pennsylvania, the Philomathean Society of the University of Pennsylvania, and/or the Wine School of Philadelphia which results in any way from my participation in such Wine Appreciation Class.
I acknowledge that I understand the nature of the obligation I am taking hereby, and I knowingly accept the same.
